RESTRICTIONS & RESPONSIBILITIES. zNET's Internet Services may only be used for lawful purposes. Transmission of material in violation of federal or state regulation is prohibited. This includes, but is not limited to: copyright material, material legally judged to be threatening, or material protected by trade secret. You agree to indemnify and hold harmless zNET, its officers, directors, employees, and successors from any and all damages, liabilities, losses, costs and expenses, arising out of or related to claims resulting from your conduct and/or use of the service, which damages you or another party. zNET is not responsible for any telephone charges incurred by dialing a number that is not local to you. Access to other networks or services connected directly or indirectly to zNET must comply with the rules appropriate for those services, including the Acceptable Use Policies established for Usenet and the Internet as a whole. Failure to observe and abide by these policies, or attempts to disrupt the Internet, may result in termination of your account. zNET prohibits the act of mass electronic mailings and Usenet News posts of unsolicited materials for any reason whatsoever. Violation of these rules WILL result in account termination. It is a customer's responsibility to maintain their web pages. zNET is not responsible for loss of data in regards to email or web pages.
zNET reserves the right to filter all email inbound to its mail servers and reject those email deemed by zNET to be unsolicited commercial email, a.k.a "spam"). zNET employs multiple methods of filtering email for spam including, but not limited to, subscribing to popularly recognized email blacklists. zNET is not responsible for any losses (monetary or otherwise) caused by our refusal to accept such mailings. If you do not wish for such mail to be filtered from your email account(s), your email account(s) will be moved to our "unfiltered" mail server upon your request.

October 1, 2002, NetHere Inc. purchased
certain assets from zNET Internet Services.
The transaction did not include the assumption
of liabilities, unless you have been
explicitly notified in writing. The companies
are not affiliated, commonly owned, or
commonly managed. Please contact the
zNET Internet Services directly for matters
related to them.
You are
also bound by the terms of www.nethere.com/policies/.
On the event of a conflict in obligations,
the NetHere Inc. policies take precedence.
PAYMENT OBLIGATIONS/LATE PAYMENTS. zNET will bill your credit card or checking account the day your application is processed. The initial charge will include applicable setup fees, setup kits, if any, and monthly fees due at that time. Payment is due in advance of Services provided, and is payable 5 days before the account anniversary date (the date your account is established), unless the account is canceled 7 business days prior to your anniversary date. Accounts established prior to 8/20/99 will have an anniversary date of the 1st of the month.
If your checking account debit, or credit card charge is declined for any reason, then your account is in default and will incur a $10 returned item fee and zNET Billing will notify you of such via email to your zNET email account. If there is no response to zNET's email within 7 days, your account will be placed on hold. If the account is not brought current within 30 days the account will be deleted. zNET cannot guarantee a users mail or web space files will be unaffected. Such interruption does not relieve you from paying past due charges. If your service is placed on hold or canceled due to nonpayment or non-collection, there will be a $10 reactivation fee for each PPP login on your account in order to resume service. Service will not be resumed until all charges have been paid in full, including the reactivation fee. There is a $25 service fee for all returned checks.
Under no circumstances may more than one-person login to any dialup account at any one time. Violators will be billed as separate accounts and will be subject to immediate account termination without warning and without any refund of unused service. zNET has the right to charge additional fees for email storage, file storage, network traffic, and access time that exceeds the base amount included with your selected account.
CANCELLATION/TERMINATION. zNET reserves the right to terminate an account at any time for any reason. zNET will only accept a written request to terminate your service. The request must be delivered in writing via electronic mail (to billing@znet.com), US Mail (4993 Niagara Ave. Ste. 200, San Diego, CA 92107) or Fax (858-713-0722). Only a written request relieves you of your obligation to pay further account charges. It does not relieve you of any past obligations and charges. If you default, you agree to pay zNET's reasonable expenses, including attorney and collection fees, incurred in enforcing its rights under these Terms and Conditions. Prepaid accounts and setup fees are not refundable for any reason if account is terminated. Any changes in billing information, including account cancellations, must be received by zNET 7 business days before your account anniversary date in order to take effect for that months billing cycle. If you wish to terminate your account, and fail to submit account cancellation notice (in writing), you will be liable for payment for services.
BILLING DISPUTES. It is your responsibility to request corrections to any processing fees each month within 60 days after receiving your credit card/bank statement. No charges will be reviewed after 60 days. Chargeback timeframes may differ as per Visa/MasterCard/American Express regulations.
DISCLAIMER OF LIABILITY. zNET exercises no control whatsoever over the content of the information passing through its systems. zNET makes no warranties of any kind, whether expressed or implied, for the service it is providing. zNET also disclaims any warranty of fitness for a particular purpose. zNET will not be responsible for any damage suffered from the direct or indirect use of its services. This includes loss of data resulting from delays, non-deliveries, mis-deliveries, or service interruptions caused by its own negligence or errors or omissions. Use of any information obtained via zNET is at your own risk. zNET specifically denies any responsibility for accuracy or quality of information obtained through its services.
ACCOUNT RENEWALS. Yearly accounts will automatically be renewed 5 days prior your anniversary date (date the account is established). Renewal notices will be sent via electronic mail at least 2 weeks prior to renewal. See the CANCELLATION/TERMINATION section for the cancellation policy.
